The United States as the Union of Soviet Socialist Republics
America is suffering from moral & civil unrest that will only destroy the culture of what America once was. The definition of a free society under classical liberalism was freedom to be left alone which is what America's founding fathers fought for. The definition of a free society under socialism is being nannied from cradle to grave with no freedom of choice & responsibility. The now deceased Confederate States of America believed in the principles of classical liberalism that George Washington, Thomas Jefferson, Benjamin Franklin, Samuel Adams & James Madison fought for in the late 18th century. The Soviet Union believed in the principles of communism & state slavery of the economy that was achieved in the 1917 Russian Revolution. The definition of a free society in the United & Confederate States of America was the freedom to be left alone & live life how you as an individual sought fit. The Union of Soviet Socialist Republics definition of a free society was welfare & oppression of free markets. Well, the United States has become the new Soviet Union. A more appropriate name for the new Amerika would be the United Soviet States of Amerika which has evolved since 1865, when the Confederate States of America was murdered in cold blood by what was supposed to be the United States of America. Although communist style central planning of the economy did not go to the extreme until Franklin Deficit Roosevelt's Raw New Deal in 1933, the bolshevik style overthrow of a legitimate government in 1865 proves my point that the United States of America died when Fuhrer Abraham Lincoln came to power on March 4, 1861, declaring his intentions to wage war on the seceding states that refused to enforce protectionist tarriffs. Of course, the US Constitution wasn't replaced but the federal courts have had the final say on federal power for nearly 150 years. The USSR has had severe moral decay throughout it's history with people living like sheep, being afraid to assert themselves on pain of bodily harm by the government. The USSA & USSR were the two superpowers during the Cold War from the late 1940's to 1990 with the fall of the Soviet Union. The United Soviet States of Amerika is very indentical to the former Union of Soviet Socialist Republics in many ways.

My Proposed Constitution: Legislative Branch Part 3
Section seven: Power of Parliment
- Parliment shall have the power to collect taxes on imports, excises, & customs to be used only as revenue for spending to support an enumerated power, pay off debts, provide for the common defense & promote the general welfare;no tax nor tariff shall be levied at a rate more than 25% of the value of the taxed object & tax laws shall be uniform throughout the several states. Should the tax fail to meet the following criteria, it shall hereby be null & void.
- To borrow money on credit of the Confederate States of Australia only if absolutely necessary, with no less than 2/3 majority vote & approval by majority of voters in 3/4 of all states.
- To enforce barriers on states imposing protective tarrifs on out of state & foreign goods in favor of intrastate commerce.
- To establish uniform laws on immigration, citizenship, & protecting all borders from invasion & foreign threats to the health & security of the several states.
- To mint money & recognize Platinum, Gold, Silver & Copper as the only legitimate standards for currency based on money supply & value of foreign currencies. Fiat currency, currency without any of the precious metal standards shall be declared an invalid currency. There shall be no monopoly on money.
- To enforce laws against counterfeiting legitimate currency & provide for the punishment thereof
- To establish tribunals inferior to the Supreme Court of the Confederate States of Australia
- Define & punish piracy & serious crimes committed on the high seas & offenses against law of nations
- To declare war, grant marques of reprisal & make laws concerning captures on land & water
- To punish foreign terrorists & their accomplices for attacks against the several states of the Confederate States of Australia
- To make diplomatic relations with foreign nations
- To raise, maintain & support militias to protect the confederation against foreign attacks & espionage as well as enforcing confederal laws. No standing armies shall be maintained during times of peace nor shall they be used for domestic law enforcement.

My Proposed Constitution: Legislative Branch Part 2
Section five: Procedure
Clause one: A quorum is required for any house to do business & each house may judge the qualifications & legitemacy of elections & each house can compel a member to attend business.
Clause two: Each house may establish rules of procedure, punish members for disorderly conduct, & with two-thirds majority may expel a member.
Clause three: Each house shall keep records of all proceedings & action, must from time to time publish all actions except those that may require secrecy & record all votes of yea or nay on all bills & resolutions.
Clause four: Each piece of legislation shall be subject to sunset clause with a simple majority vote having a sunset clause of no more than nine years, three-fifths majority with no more than twelve years, two-thirds majority with no more than fifteen years & a three-fourths majority having no sunset clause. The sunset clause will nulify any law that has exceeded the anniversary of it's date of effect.
Clause five: Neither house during session may adjourn for more than three days without consent of the other house.
Section six: Budget, Bills & Compensation
Clause one: No compensation other than what is necessary to maintain service shall be granted without majority approval from their electorate.
Clause two: All revenue bills must originate in the house of representatives.
Clause three: Any bill passed by both the house & senate shall be sent to the states & people for a vote. Any bill which which does not recieve a majority of states either through popular vote or state legislature approval within two years after the passage of the bill in both houses shall not be valid.

Section one: All legislative powers shall be given to the Parliment of the Confederate States of Australia, with both a house of representatives & a senate.
Section two: House of Representatives
Clause one: Representatives of parliment will be chosen every two years, three months, & nine days excluding national holidays & shall require the elections to be seven days long ending on the deadline prescribed in this section with the deadline for run off elections being thirthy two days after general election deadline & shall also require elections to be seven days long before final deadline with the first parlimentary elections taking place eight months & nine days after ratification of the constitution. Each representative will have one vote.
Clause two: Representatives must be eligable to vote in their home state, been a citizen of the Confederate States of Australia for seven years, & reside in the district they represent.
Clause three: Representatives shall be based on population not exceeding ratio of one to two thousand with each state being promised one representative with a census being taken every tenth year & apportionments made no later than two years after census taken & all direct taxes shall be equally proportions amongst the states & people represented in parliment. Original representations shall be based on the original representation from the previous federation until the first census is conducted. The first census shall be conducted in the first xxx0 year after the ratification of the constiution.
Clause four: In the event of vacancy in the house, a special election shall be called with a deadline of four months & nine days after the vacancy occurred, but shall not require special election if it is conducted four months & nine days before the general election.

Clause one: The senate of the Confederate States of Australia shall have three senators for each state & each senator shall be elected by state legislatures. Each term in the senate shall be three parliments, which in total last six years, nine months, & twenty-seven days. Each senator shall have one vote.
Clause two: Elections for senators will be divided into three classes with class A being elected at the expiration of the first parliment, class B at expiration of second parliment, & class C at expiration of third parliment, continuing the pattern. All three senators shall each be assigned a class A,B, or C. Should vacancy occur, the state legislature shall appoint a replacement senator to finish the rest of the vacant term & should the state leigslature be absent at the time, the executive of that state shall appoint the replacement until the state legislature convenes.
Clause three: Senators must be eligable to vote, have been a citizen of the Confederate States of Australia for nine years, & be a resident of the state represented.

No representative nor senator shall be elected without fifty percent or more of the popular or state vote. All political parties & independents shall be treated with political equality including but not limited to reasonable number of signatures required for ballot access in which each party or independent candidate may have to obtain. There shall be no interference with the selection of candidates by political parties for general elections so long as the selection is made before the nomination deadline. Each state shall set a nomination deadline for candidate which must be no earlier than eight months nor later than three months before general election.

My Proposed Constitution: Preamble
We The People hereby establish a confederation of independent & sovereign states which join solely on a voluntary basis on matters such as foreign policy, national defense, & protection of free trade & migration. Unalienable rights come from our creator & are never to be repealed by man-made artificial laws under any circumstances & neither are the foundations that keep the individual states of the confederation sovereign to be changed as to severely surrender the sovereignty of any of the several states against their will.
Every constitution needs a preamble & that's a preamble! The first step in creating a new constitution would be to lay out the foundations for my proposed confederation. As you can see with a preamble like this, the new constitution is a libertarian document.

When a New Constitution is Needed to Protect Liberty
I'm considering leaving the United Soviet States of Amerika for Queensland, Australia hopefully by August of this year & I noticed that the Australian Constitution is not a libertarian document like the former United States of America constitution. I was thinking that in order to protect liberty & shrink government, Australia must adopt a new constitution that is modeled heavily on the Constitution of the former Confederate States of America (1861-65). The new constitution of Australia would need to meet a constitutional convention where mostly Libertarians, Classical Liberals, & laissez-Faire economist activists would be welcomed with open arms. Communists, socialists, fascists & big government centralists would be barred in order to protect liberty & the new constitution from becoming socialist and/or fascist. The new constitution would be based on the philosophies of John Locke, Thomas Jefferson, Adam Smith, Ludwig Von Mises, Frederich Hayek, Murray Rothbard, Aristotle, Judge Andrew Napolitano, & Ron Paul. I know that John Humphreys, libertarian economists & founder of the classical liberal/libertarian Liberal Democratic Party will be one of the most important Australians at my supposed constitutional convention. I also know that senator Cory Bernardi of South Australia is also a libertarian leaning conservative. Another political party that's an important player is Katter's Australia Party that is registered in Queensland. A perfect place to hold the constitutional convention would be in Perth, Western Australia at a convention center. My agenda for a new constitution would be to establish a confederal government like the former Confederate States of America (1861-65) that addresses the issues associated with seperate nations such as foreign policy, interstate trade & travel, civil documents such as drivers licenses, currency, weights & measurements, & naturalization & immigration. All other powers will be reserved to the states & people including the right to secede. Of course, the confederal government would have the power to tax, but only to raise revenue for spending on a specific government policy. The new constitution would also have to have a preamble laying out the foundations of the new confederation that say rights come from our humanity & that they can NEVER be repealed by government laws under any circumstances. Neither could the constitution be amended to compromise the sovereignty of the states. The new constitution should also include a bill of rights just to send the message that rights come from nature & humanity. After the constitutional convention is complete & arrangements for a new constitution have been drafted, it shall go to the voters, although I will offer different varieties of the referendum so I can increase the possibility of an Australian confederation passing. The new constitution proposals will reach the ballot whether the federal commonwealth likes it or not. Hopefully confederation will send a message to the socialist Labor Party lead by Julia Gillard (Current Prime Minister) & the fascist Liberal-National coalition lead by Tony Abbott. The confederation movement will also send a message to the judicial system implying that we ain't gonna take judicial tyranny! My proposed Australian Confederation will have a lot in common with the Southern United States, hopefully reviving the Confederate States of America. If the Australian Confederation & the former Confederate States of America merge together through voluntary union, then the new confederation will be called Confederate States of Ameristralia. If not, it will just be called the Confederate States of Australia. Either way, long live the Confederacy!
