John G. Roberts was nominated by George W. Bush seven years ago & yet the former wrote the majority opinion upholding Obamacare, betraying federalism & serving the establishment socialists & fascists. Mitt Romney claims he will repeal Obamacare but do you know about GOPcare which establishes their own socialized healthcare. The GOP establishment still holds it's grip on power & behind closed doors have cheered their most favorite of justices John Roberts so they can feed off of people's outrage & gain more votes. The Democrats suck even more & I want both parties to die! By die I mean be defeated in massive landslide elections where minor parties & independents gain most of the seats, reducing the Dem/GOPs as nothing more than maggots whose amount of members in congress are a mere mini fraction compared to the Constitution-Libertarian-Green coalition combined.
The Republicans will be even more vulnerable than Democrats which will result in the death of the GOP to the Constitution-Libertarian-Green-others after the 2016 elections should major party status be erased. Demolishing major party ststus laws alone will not entirely solve the problem but will be a tremendous step forward but more work will still need to be accomplished.
I believe in the numerous conspiracies that voter fraud is occuring such as rigged electronic voting machines which needs to cause severe alarm as elections will become undemocratic & the same things that are happening in Iran & Russia will happen in America if this does not change.
Both the Democrats & GOPs want a one-party state either by crushing the other party or merging with each other. The mainstream media will be promoting this & the 2012 election will decide if America is to have a socialist or fascist regime. Either way, a one-party state will occur unless major party status laws are destroyed.
What else determines elections is money. Campaign finance laws are complex & the only way candidates will get recognition is for spending to be high & financing to come from anywhere.
What about the mainstream media? Luckily there's a media company called TheBlaze which has libertarian/conservative broadcasting from personalities like Glenn Beck. But TheBlaze is not yet the same level as socialist MSNBC & National Socialist Fox News but with enough nuturing, we can get there & spread the word by aggressively slamming the establishment & humiliating the Dem/GOP regime.
What we need is a several step plan to bring elections to fairness.

What Will Happen After "Major Party" status is destroyed?
Without the Democrat & GOP's Major Party status laws protecting them from competition, they will most likely fall within a few years tops. Dislike for both parties is getting higher & the only major life support they can get are "major party" laws. There are other oppressive laws such as campaign finance restrictions, non-majority elections, inadequete representation, voter fraud, & bans on fusion candidacies. but without major party status laws, the major parties can't be god-like powerful in politics.
The first objective is to get major party status laws struck down without comprmise. Then it will be the duty of citizens to enforce such a ban on major party status & protect our elections from fraud.
When that happens, the first election to occur after that will see HUGE losses for both Democrats & Republicans & major gains for Libertarian, Constitution, Green & other politicial parties/independents due not only to many Dems & GOPs losing their seats in elections but numerous Paleoconservatives, libertarians, social liberals, & other disgruntled voters will defect from the democratic & republican parties as soon as major party status laws fall like the Berlin Wall. There will even be some gains just before the first election such as Libertarian & Conservative Senators/Representatives such as Mike Lee of Utah, Justin Amash of Michigan, Tom McClintock of California, Jim Demint of South Carolina, Ron Paul of Texas, Rand Paul of Kentucky, & Dennis Kucinich of Ohio would switch to either the Libertarian, Constitution, or Green parties as examples.
Jake Towne of Lehigh Valley, Pennsylvania ran as an independent in the district represented by neoconservative republican Charlie Dent but sadly lost as expected because people feel battered into sticking with either Dems or GOPs. If major party status laws were demolished, Jake Towne would have had an even stronger chance against the Dems & GOPs & the more handicapps demolished & the more electoral reforms are passed, the higher chance Towne like other non-major party candidates will have towards winning election. Towne would have easily beat Dent by a landslide had people known more about the former. Same would go for many other independents & other anti-establishment candidates as they would not have to run in the rigged Dem/GOP primaries that have for many years ended up producing establishment candidates.
The Tea Party movement is credited for slowing down establishment progress & electing more anti-establishment candidates. People will have a real choice once all parties/independents are required to play by the same rules without exceptions.
An example of this would be a congressional race for Nancy Pelosi's seat in San Francisco. The race would be between Rosanne Barr(Green), John Dennis(Libertarian), & Nancy Pelosi(Democrat). If San Francisco voters are wise enough to see Pelosi's evil, Barr & Dennis would unseat Pelosi & go for a runoff election. San Francisco 9s supposed to be a green-libertarian city but is instead socialist.
I can name other semi-major parties such as the Reform, Independence, Modern Whig, Peace & Freedom, & American Independent Party(California version of Constitution Party)
If my dream for fair elections come true, the Constitution Party would win the most positions in Federal Congress with the Green & Libertarian parties having a narrow edge betwwen 2nd & 3rd place.
Many states will have different parties such as Alaska having the Alaskan Independence Party as having the most positions in legislatures, Florida Whig-Constitution parties being majority coalition in Florida, Greens, Libertarians, & American Independents having the most seats in California, Aloha Aina Party in Hawaii, Oregon having legislature composed mostly of Constitution, Independent, Progressive, & Working Family Parties in which the first would have most seats & the last would have least seats, New York State would have several parties in legislature in which the Conservative party would be the state version of the Constitution Party, New Hampshire would be highly Libertarian with the Libertarian Party having a supermajority in legislature, Massachusetts would gain reputation as having the most independents & Greens in legislature, Vermont Pregressive Party, Liberty Union & Working Families parties will form majority in Vermont legislature, plus a supermajority of seats in the legislatures of Idaho, Montana, & Wyoming will be occupied by either Constitution or Libertarian candidates.
Every state will have different kinds of political parties that do not run at the federal level. Political parties & independent candidate are engaging in a sport/game when they run for office & must all play by uniform rules & qualifications.
If a political party is to be considered a political party rather than an independent, it must have more registered voters than the number of signatures required to get a candidate on the ballot. Otherwise, the candidate they select will be considered an independent. Political parties shall be free to choose the mode of nominating candidates & what other parties it shall associate with. Fusion candidacies with the consent of all participating parties shall not be infringed but if a candidate is to run for both as an independent & one or more political parties, he/she shall be required to collect double the amount of signatures.
All candidates regardless of party shall abide by the electoral rules & any candidate in violation of these rules shall be barred from running in the election.
Here's how someone would qualify for the ballot. A political party that has a certain number of supporters will be registered as a party on the electoral roster & an independent who has gathered enough signatures(supporters) shall be admitted on the roster as an independent. If a political party does not have enough supporters to be considered a roster political party, then all of it's candidates will be considered independents.
A unique political party American's Elect is a force fighting for fair elections & could be the plaintiff in a class action lawsuit against the electoral boards across America, dooming the Dems & GOPs in the courtroom. The Supreme Court is supposed to be impartial but has not been for decades. By applying pressure to the courts, we can achieve victory. If we have to take direct action against the rogue electoral commisions, we will pursue such an action in order to force compliance with our demands.
The court system is so dysfunctional & corrupt that the fiar election movement may have to bribe judges to rule in the former's favor. I want fair game elections to take place before the 2014 elections so the deadline I hope to achieve up at the supreme court should be by August 2013-January 2014. I hope the brave Americans Elect movement's lawyers will humiliate & degrade the Dem/GOP lawyers into embarrasement, leaving the Dem/GOP arguments nothing more than nervous mumbling & stammering like you can't understand what the hell they're trying to argue.

Why Major Parties Hold Their duopoly
The secret weapon major parties use is "major party" status giving special privilages to Dems & GOPs over others. Major party status has prevented thrid parties & independents from being on the ballot due to burdens of ballot access laws. The U.S. Constitution mentions NOTHING about political parties & thus major party status laws granting special privilages to major parties such as protecting them from third party/independent competition through democratic mercantilism are unconstitutional. If a court were to struck down laws placing protectionist burdons on minor parties & independents(thus requiring all parties/independents to be subject to a uniform ballot access rule), that would create a landmark ruling, advancing fairness in democracy & a devastating blow to the party duopoly.

Fascists & National Socialists in New York City Arrest Bruce Willis' Daughter Scout on Underage Drinking/Fake ID Charges(June 5-6)
The NYPD or should I say Gestapo led by Commisioner Raymond Kelly & Mini-Fuhrer Mike Bloomberg arrest many good people like Scout Willis on victimless charges such as in her case underage drinking & fake ID possession which alone have no identifiable victim. Her 21st birthday is in july of this year yet the reason for her arrest other than the New York penal code is that one, her brain wasn't developed enough until her 21st birthday & second she was too imature to responsibly drink beer despite being eligable for adult sentances such as life imprisonment & capital punishment(which is non-existent in New York). Adult responsibilities but youth apartheid truly questions & casts doubt on the constitutionality of the drinking age imposed by force on age of majority youth. Hell there was a young man named Lionel Tate of Florida who became the youngest person sentanced to life without parole for a crime he committed when he was 11. Eleven year olds aren't even adolecents yet an 11-12 year old at the time of the crime could still receive adult consequences.
I'm all for personal responsibility & being held accountable for actions but the arrest of Scout Willis goes too far by breaching due process rights. Ok now how can someone be unaware of the consequences of their actions for drinking, driving, & gun ownership yet be held criminally & civilly responsible for drunk driving, vehicular manslaughter, & firearm crimes? It doesn't make sense. It's like prosecuting a dog for any crime because even though dogs are clearly not humans & don't enjoy the same civil rights as humans. Same goes for children. The reason children do not have adult rights such as signing into contracts is because they are considered too immature for that. If that's the case then children should NOT be punished as adults, plain & simple although they would still have the obligation to pay restitution to their victim(s).
Due process position on this is simple: Children under age of majority cannot be forced to face adult consequences & Adults over age of majority cannot have ANY adult rights infringed on requiring Scout Willis's charges & upcoming convictions overturned just like the legal drinking age & any convicted of violating it.
The fascists, national socialists, progressives, & communists reject due process as a barrier to their power, which is something most government bureaucracies favor. Mike Bloomberg is one of the fascist-national socialists favoring regulations on what people can eat & drink such as the recent large soda ban. They favor gun control because gun ownership is a check on tyranny & thus threatens the power of the regime.
Tyrannical government & corrupt democratic systems are what raise moral for direct violent resistance against government agencies such as the IRS when a patriotic victim of IRS oppression Joe Stack flew his piper dakota plane into the audit section of the IRS building in Austin, Texas on February 18, 2010. I want to apologize for insulting Vernon Hunter because even though he was decent as a person, he still was working for the enemy. It's nothing personal, just resisting government tyranny. Patriots & the government are at war with each other with patriots fighting for restoration of the constitutional republic verses government fighting for the current regime & resisting any attempts by militant patriots to restore American constitutionalism.
There was a 21 year old man named Oscar Ortuega who on November 11, 2011 went to the White House in Washington D.C. on a mission to assassinate Fuhrer Obama which of course failed because Obama was not in the White House at the time. I have to compare Ortuega's attempt to assassinate the American Fuhrer to the 20 July Plot to assassinate Adolf Hitler & overthrow the Nazis in 1944 on grounds that Obama can be easily compared to Adolf Hitler & Joseph Stalin's dictatorships.
I'm not implying that people should assassinate the president but I favor armed resistance against any law enforcement officer or any armed force member trying to indefinitely detain anyone under the NDAA. Gun ownership is the biggest fear of tyrannical government because if people have the ability to resist secret police & regime militaries, then people will no longer fear the government like they do in North Korea.
Bottom line: children should be raise by parents & parents should not be punished for the way they raise their children so long as it is not ACTUAL child abuse or neglect & adults MUST have ALL adult rights without exception.

How The American Civil War Could Have Ended Differently
1862 was a notable year for America. It was the second year in the South's war for independence. Two major war crimes perpetrated by Union generals during this year included General Sherman's rape & plunder of Atlanta plus General Butler's blood bath of New Orleans.
Robert E. Lee was one of the greatest military geniuses in history who bravely led the Confederacy during the American Civil War. One of the major assets the Confederacy had was slaves, which could have been used as troops for the Confederacy & then granted freedom once the war was won. Union General Winfield Scott crafted his anaconda plan which created a blockade against the Confederate States.
The Battle of Gettysburg was a very notable battle in which the Confederacy advanced into Union territory in the third year of the Civil War. This is important because it represented a breach against the blockade imposed by the Union. Plus, had the Confederacy prevailed at Gettysburg, that would have been a turning point in the South's favor, inspiring resistence movements in the North as well. South California below the 35th-36th parallel would have seceded & joined the Confederacy in order to help the South win independence from the Union.
A Southern victory at Gettysburg would have increased Confederate moral & decrease Union moral as the Union would be tainted by war crimes of aggression. The false emancipation proclaimation would have never been in effect because the Confederate government bought many of the slaves during the first & second years for use in the civil war.
The Union found out about the material support granted to the Confederacy by the British & French & Lincoln orders an attack on British & French ships. During the 1864-65 term of the Civil War, the British & French call in their navies to aid the Confederacy by breaking up the blockade. Important supplies such as weapons are able to reach the coasts of the Confederacy.
The Confederate armies start to liberate occupied territory. Generals Grant & Sherman are killed in attempts to secure their holds on major Confederate territories. Union General Thomas Darlington becomes the major Union general in charge after Grant & Sherman's deaths.
In 1864, many northern states including New Jersey, Vermont, Maine, New York, Oregon, North California, Ohio, Delaware, & Massachusetts form a provisional secessionist movement protesting the Union aggression & become aligned with the Confederacy. Unlike the South, these state don't plan on creating a union of their own but merely to stop Lincoln's war to prevent independence. Former President Franklin Pierce is elected Governor of New Hampshire & urges the state to join the resistance movement. He is shortly ousted & exiled to Massachusetts where is elected president of the provisional resistance movement.
The British establish a provisional dominion amongst those protesting states in an effort to stop the disrupt of Atlantic trade caused by Union forces. The British use their navy to destroy the Union blockade in order to stop the disruption of trade, which mostly relies on the Confederate States.
By 1866, the Lincoln Union states left were Pennsylvania, New Hampshire, Connecticut, Rhode Island, Indiana, Michigan, Wisconsin, Illinois, Kansas, Iowa, Minnesota, West Virginia, & Nevada. Lincoln's Union was outnumbered thanks to the resistance. While Confederate moral was rising, Union moral was plummeting. Congress feared the collapse of the Union & moved to impeach Lincoln. In response, Lincoln had numerous members of congress arrested but were soon freed after protest movement troops led by Rutherford B. Hayes & George McClellan raided Fort Lafayettes, where prisoners of war were held.
On March 14, 1867, the Invasion of Washington D.C. by Confederate, Protest, French, & British troops commenced on a mission to arrest the Lincoln regime. What they didn't know is that Lincoln fled to Canada after the rest of Union was occupied by Protest troops & all Confederate territory was completely free from occupation. What is today Clark County was ceded to Nevada, USA, so all of Nevada's present day territory would have still existed.

This is important because it represented a breach against the blockade imposed by the Union. Plus, had the Confederacy prevailed at Gettysburg, that would have been a turning point in the South's favor, inspiring resistence movements in the North as well. South California below the 35th-36th parallel would have seceded & joined the Confederacy in order to help the South win independence from the Union.
A Southern victory at Gettysburg would have increased Confederate moral & decrease Union moral as the Union would be tainted by war crimes of aggression. The false emancipation proclaimation would have never been in effect because the Confederate government bought many of the slaves during the first & second years for use in the civil war.
The Union found out about the material support granted to the Confederacy by the British & French & Lincoln orders an attack on British & French ships. During the 1864-65 term of the Civil War, the British & French call in their navies to aid the Confederacy by breaking up the blockade. Important supplies such as weapons are able to reach the coasts of the Confederacy.
The Confederate armies start to liberate occupied territory. Generals Grant & Sherman are killed in attempts to secure their holds on major Confederate territories. Union General Thomas Darlington becomes the major Union general in charge after Grant & Sherman's deaths.

The Most Corrupt Party in North America
In Alberta, the Progressive Conservative has ruled Alberta for 41 years consecutively. PC is a tory party that is supposed to be centre-right when in reality it is the party of political corruption. The leadership of the party with it's chief Allison Reddford, who is also premier has made Alberta's government corrupt as hell. Not only is Reddford the WORST Premier in Alberta's history, she is also probably the WORST incumbent leader of any political party in North America. The Progressive Conservative regime has maintained a grip on political corruption by expelling ANY party member in the Legislative Assembly that disobeyed PC leadership. This happened to now Liberal leader Raj Sherman who was expelled from the PC for criticizing party leadership on their failing healthcare issues.
PC's budget is horrendous! Even the New Democrats, a left-wing party is are more fiscally responsible than PC is. The Progressive Conservative party is possibly more socialist than the New Democratic party. Hell, I don't know if the PC is communist or fascist but I do know they are corrupt as hell. There is no head of government, either at the federal level or at provincial level that is more corrupt & despicable than Allison Redford. She is at the bottom of the barrel in Canada. Only Bob Rae as premier of Ontario(1991-95) did worse. You could compare Redford to Pierre Trudeau, the worst prime minister in Canada's history & a staunch National Socialist.
Fortunetely in the 2012 Alberta General Elections, the new right-wing Wildrose Party led by libertarian beauty Danielle Smith gained 14 seats in the Legislative Assembly while the Progressive Conservative Party net lost five seats & yet still retained a majority. The Wildrose had a slight lead in popular opinion & yet won only 34% of popular vote compared to PC's 44%. The Wildrose did make history when it became the official opposition party & managed to slightly weaken PC's majority. Hopefully in the next election in 2016 or hopefully earlier will see a massive gain for both Wildrose & Liberals & a humiliating loss for the Progressive Conservatives. Hopefully 2016 will se the Progressive Conservatives not see even official opposition status. If that happens then I predict the Alberta Liberal Party would be the opposition. The Liberals in Alberta are centre-reformists led by PC expatriate Raj Sherman. The Liberals lost 3 seats but no incumbents in the Liberal party were defeated. Although the PC still retained a majority after the most recent election, they lost the most seats & Wildrose gained the most.
Comparing Redford & Smith, a lovely woman like Smith should be compared to a beautiful princess while Redford should be compared to the evil queen from Snow White.
In order for Wildrose to gain a majority, the PC would have to lose 18 seats & the Wildrose would have to gain 27 seats out of the 87. What Wildrose could do is form a coalition government with the Alberta Liberals who now have 5 seats but I don't expect them to gain many seats.
I will say that if the PC continues their corrupt-partisan path, many members will defect from PC & more conservative members will join Wildrose while centrists will join Alberta Liberals. I don't know if there are any social democrats in the PC but I can expect them to join the New Democratic Party.
The Federal Government of Canada also sucks as Stephen Harper is more of a neoconservative hack than a true leader.
Why am I analyzing a Canadian Provincial election? Because the Progressive Conservative Party led by Alison Redford should be the poster child for non-partisan politics such as elections WITHOUT regards to political parties. Political parties should function only as private political action committies.
Since the Progressive Conservative expels members who vote against their unfair policies, members who are dissatisfied should defect to the Wildrose & Liberal parties depending on if they're centre or right wing.
If you are eligable to vote in Alberta, renounce your membership to the Progressive Conservative Party. Weaker membership for the PC is a step towards their defeat & eventual extinction.
In America, there's no Wildrose party so the best hope for political reform is through the courts. The courts are independent from political pressure & should strike down laws favoring political parties. Political parties are something the founders feared & the constitution disapproves of partisan elections. I could only imagine what would be if Republicans & Democrats acted the same way as Alberta PC.

When I Publish My Book
I sure hope that when I publish my book arguing for anarcho-capitalism that I can make an honest living that will give me upper middle class assets but possible by $250,000-$1,000,000 from revenue.
I've heard of this program online in which you can get a living wage just for taking surveys http://www.getcashforsurveys.com/. It does depend on how long you work for but you can make a living wage of around 36,000-132,000 annually. I predict that the average wage I will make hourly is around $132 per hour. I want to make over $60,000 per year on these surveys I will have to do surveys for over 455 hours each year. On average I should do 3-4 hours for 150 days a year. With that I should have an annual income of $79,200. If I want to make over $60,000 a year doing surveys, I will have to make $5,000 a month & $1,250 per week. If I work four days per week & will need to make over $312.50 per day meaning that I will have to work no less than 2 hours & 21.6 minutes. I'm not exactly sure how much I will be making exactly from these surveys but in this hellish economy I can say that it beats working in a 9am-5pm job for minimum wage. The guest immigrant workers can do the menial low-paying jobs we don't wanna do, like take out the trash, clean streets, & pump gas as examples.
Getting cash for surveys makes so much sense because companies spend billions on consumer science & that demand is greater than janitors or cashiers & thus it pays more.
With this money I hope to rent an apartment for under $2K per month in Southern California, but only the clean parts of it. I also want to buy a Tesla Model S Performance & the Tesla Model X performance once it comes out. I might wait until the Model X comes out & instead use my not yet decided class B motorhome as my primary vehicle.

Why elections MUST be non-partisan
The awful GOP establishment wants to expel Ron Paul & his supporters. This is alarming since election laws establish partisan two-party elections. The founding fathers never intended for political parties to be given legal status over disadvantaged independents. The Democrats & GOP have failed to bring government reform. What's even worse is the establishment GOP would prefer an establishment Democrat over a Conservative Republican.
Democracy in America is dead & replaced with a dual one-party system. What I mean by dual one-party system is that although it appears there's a choice in elections, it's really a fusion between establishments most of the damn time. Under the Bush regime, GOP establishment was dangerously high & very few were actual conservatives like Ron Paul. America will NEVER gain real democracy back if we continue to have partisan elections favoring political parties & for people who still have faith in the undemocratic elections that take place are misguided & ignorant of what electoral reforms must take place!
Ballot access needs to respect INDIVIDUAL candidates, NOT political parties meaning that each candidate having the right & equal # of signatures 120 days before the general election will obtain ballot access regardless of political party meaning NO legal party primaries. Of course, political parties could choose freely who to endorse but cannot force other candidates out of the election. This will make it easier for independents & third parties to get a fair shot.
Democracy needs majority elections & every voter in primary election should have two votes & in the runoff election every voter will have just one. My proposition will make elections more democratic & give candidates regardless of affiliation a fair shot.
If there were non-partisan elections, not only would I be voting for Libertarian & Constitution Party candidates, I would be able to be a member of as many political parties as I want. If elections were non-partisan, the GOP would be weak due to membership declining with conservatives & libertarians like Ron Paul joining the Libertarian, Constitution, Reform & other right-wing parties that actually keep promises.
We cannot continue to have this dual one-party system & a lack of direct democracy. We must have Swiss Style Direct Democracy or else we will be battered by politicians unless we take up arms.
When democracy fails, the right to take up arms against tyrannical government becomes more important than ever.

North America Partition
The U.S. & Canada are not two nations. They are several. Of course I want to convey suggestions for how the U.S. & Canada should be divided.
Southern Confederate States of America would include: Virginia, West Virginia, Maryland, North Carolina, Tennessee, Kentucky, Missouri, Arkansas, Oklahoma, Texas, Louisiana, Mississippi, Alabama, Florida, Georgia, South Carolina, New Mexico, Arizona, & South California. The Flag would be the Old Confederate flag.
Northern Confederate States of America would include: Ohio, Indiana, Michigan, Illinois, Wisconsin, Iowa, Kansas, Nebraska, Colorado, Utah, Nevada, & North California. The flag would be the Union flag.

Louisiana, the Reactionary State?
Could Louisiana be headed back to 19th century liberalism? What I mean by 19th century liberalism is the return to limited government before the Progressive Era. Louisiana is making a bold agenda to privatize public indoctrination prison schools & provide funding for students to be educated. This is a great leap forward for decentralizing education & return to how education was handled in the classical liberal era. Education before the early 20th century was voluntary in the Southern American states meaning that there was no cirriculum, no compulsory education & children were mostly educated at home. The Southern & Western American states throughout much of their history favored free-enterprise & were distrustful of centralized government. The Prussian-Marxist model of education was first passed in Massachusetts in the 1840's & extended like cancer throughout America & Canada. The last state to end voluntary education was Mississippi in 1917.
Public education is a Marxist nightmare for American patriots whose ancestor patriots fought British & Union tyranny. There was no compulsory education anywhere in America when the U.S. Constitution was drafted in 1787 & yet the founding fathers were well educated beyond today's standards. High school students are far less educated than many in 18th century America despite compulsory education.
What's really bullshitty is the sentencing of 17 year old Texas honor student Diane Tran to one day in jail for the fabricated crime of "truency". Efforts to crack down on truency are authoritarian & marxist. Plus, being forced to attend school does violate someone's right to liberty so compulsory schooling is prison! A 1967 US Supreme Court ruling "In Re Gault" requires due process be conducted without regards to age.

The Despotic Totalitarian Snake of "The Law Is The Law"
What the hell is "The Law Is The Law" anyway? The despots in the judiciary say it means that ALL laws no matter how unjust & unconstitutional should be obeyed & any violators should be punished unless the judiciary says otherwise. It could be said that if a law is unconstitutional, the person harmed by the government's actions could simply go before the courts & argue the law is illegal or unconstitutional. However, this is rarely the case as judges have nearly no incentive to uphold the law they are bound to uphold. The Supremacy clause applies to ALL judges, not just state judges. It was an awful blow to the rule of law when Federal Judge Edward Lodge of Idaho halted the prosecution of Ruby Ridge sniperer & federal agent Lou Horiuchi who was charged by the state of Idaho for manslaughter in 1997. The Supremacy clause does not grant the federal government immunity from being held accountable for it's actions from the state & local governments if the federal government violates the law. How do the DC despotic elites respond to them apples?
The founding fathers never approved of the judiciary being the sole arbitrator of all legal matters. Thomas Jefferson was against an activist judiciary & wrote alongside with James Madison the Virginia & Kentucky resolutions of 1798 stating that the states & the people have the right to nullify unconstitutional federal laws. This was in response to the Alien & Sedition Acts of 1798 which made it a crime to speak out openly against any public official in the federal government. I know what many are thinking the point that we have elections in which we can just vote the douchebags out of office. However, my point being is that it hardly ever works. The GOP or the "Gang of Plunderers" as I like to now call most of them has ultimately failed to follow in the foot steps of classical liberal presidents like Thomas Jefferson, John Tyler, Grover Cleveland, & Calvin Coolidge of actually cutting spending & lowering taxes & actually limiting government. Ronald Reagan became president from 1981-9 promising the same things as Thomas Jefferson, John Tyler, Grover Cleveland, & Calvin Coolidge. Reagan actually increased spending & deficits dramatically & after signing one of the largest tax cuts in history during his first year of office, he approved of higher taxes the next year. The Tax Reform act of 1986 made the tax laws more complicated & the blood is on the IRS hands for engaging in economic repression by choosing to enforce such horrible laws. When Republicans became the majority party after the 1994 elections, the spending & deficits continued & only got worse under Bush. Obama's agenda for "Change" in 2008 ended up with extreme authoritarian neo-communist government.
Another question that might be asked is if a law is unconstitutional, why not appeal to the courts? Appealing to the courts is not my point. The judiciary is despotic & unless the judges presiding over the cases are benevolent enough to rule in liberty's favor, then you're screwed.
The rule of law has been replaced by rule by lawyers, bureaucrats, & politicians. The position that any violator of any law no matter how tyrannical should be punished harshly in order to maintain order is a position begging for totalitarian government in which people are slaves of the state. Such a state exists in North Korea where people are forced to absolutely obey the supreme rulers known as the Kim family. The Supreme Ruler of North Korea is completely above the people & only answers to himself.
